These Terms and Conditions of Use and Privacy Policy apply to individuals and institutions (“you”) visiting the Website, and, by downloading, printing, distributing or otherwise using or exploiting materials or content (“use”) on the Website, you hereby agree to comply with the Terms and Conditions detailed here. The Transgender Training Institute (“TTI”) doing business as Trans-Affirming Training & Consulting (“TATC”) does not warrant that use of any materials or content displayed on its Website will not infringe the rights of third parties.

The Trademarks may not be used except to provide attribution as specified above. Nothing contained on the Website should be construed as granting, by implication or otherwise, any license or right to use any trademarks, service marks, logos or design elements displayed on the Website without the express written permission of Powerplay or any third party that may own such marks displayed on the Website.

• The Website and the content made available through this site are for educational and informational purposes only.

• Powerplay makes no representations or warranties of any kind, express or implied, as to the Website’s operation or the information, content or materials included on the Website; all of which are provided on an “as is” and “as available” basis. An IP address is a number automatically assigned to your computer whenever you access the Internet. If a visitor requests pages from Powerplay, Powerplay servers enter the visitor’s IP address into a log. The first time Powerplay serves you a page, our site places a text file called a “cookie” in the browser files of your computer. Powerplay Enrollment Course Policies

• Better in Bed is a self-paced digital course. Once your registration is confirmed and course access is provided, your purchase is considered final and course fees are non-refundable, except where otherwise required by applicable law or as expressly provided below.

• Because access to the course and its digital materials is provided upon purchase, we are unable to offer refunds based on how much or how little of the course you have completed. Choosing not to complete the course, changing your mind after purchasing, or being unable to complete the course within a particular period does not automatically qualify for a refund.

Exceptional Circumstances

• We understand that unexpected circumstances can arise. If an urgent and significant situation prevents you from reasonably participating in the course, please contact Power Play as soon as possible. While such circumstances do not automatically guarantee a refund, we may review the situation and, at our discretion, offer an alternative accommodation such as extended access or another reasonable solution.

Course Materials & Access

• Your purchase provides you with a personal, limited, non-transferable license to access and use Better in Bed for your own educational purposes. Course videos, recordings, written materials, worksheets, exercises, and other resources are proprietary to Power Play and may not be copied, downloaded where downloading is not expressly provided, recorded, reproduced, redistributed, resold, shared with others, or used to create a competing or substantially similar program without written permission.

• Refunding, canceling, or otherwise reversing a payment does not grant permission to retain, reproduce, or continue using course materials. Where access is revoked following a refund or other approved cancellation, continued access or use of the course materials is prohibited.

• By purchasing Better in Bed, you acknowledge that you are purchasing access to a digital educational program and agree to these terms.

Power Play Terms of Participation & Use

Thank you for choosing to participate in Power Play programs, workshops, classes, digital courses, events, and other educational offerings.

These Terms of Participation & Use ("Terms") apply to your participation in Power Play programs and your use of Power Play's website, educational materials, digital content, and related services.

By registering for, purchasing, accessing, or participating in a Power Play offering, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree with these Terms, please do not register for or participate in Power Play offerings.

Power Play reserves the right to update these Terms from time to time. The version in effect at the time of your participation will generally govern your participation, except where otherwise required by law.

1. Eligibility

Power Play offerings are intended for adults age 18 and older unless a specific offering expressly states otherwise.

By registering for or participating in Power Play, you represent that you are at least 18 years old. Power Play does not knowingly provide sexual wellness education or related services to individuals under 18.

2. Educational Nature of Power Play

Power Play provides educational wellness, movement, sexual health, and intimacy-related programming. Our offerings are intended to provide information, education, reflection, and practical tools.

Power Play is **not a medical practice, mental health practice, or substitute for individualized medical or mental health care**. Our educational offerings do not diagnose, treat, or cure medical or mental health conditions.

You are responsible for determining whether a particular activity, movement practice, or educational exercise is appropriate for you and for seeking appropriate professional advice when necessary.

3. Registration, Payment & Refunds

Registration for a Power Play offering creates a commitment to pay the applicable registration fee.

Refund and cancellation terms may vary by offering and will be provided at the time of registration. Where an offering has a separate refund or cancellation policy, that policy is incorporated into these Terms.

For digital programs, including Better in Bed, access to digital course materials may be provided immediately upon purchase. Because digital educational content is made available upon purchase, applicable digital-course purchases are generally non-refundable except where otherwise required by law or expressly provided in the applicable course policy.

Power Play reserves the right to cancel, postpone, modify, or reschedule an offering when reasonably necessary. If Power Play cancels an offering, participants will be notified and provided with the refund, credit, transfer, or other remedy applicable to that offering.

4. Respectful Participation

Power Play is committed to creating educational spaces where participants can explore wellness, sexuality, embodiment, identity, relationships, and pleasure without harassment, intimidation, or discrimination.

Participants are expected to:

• Treat Power Play staff, facilitators, instructors, guest speakers, and other participants with respect.

• Follow reasonable instructions provided by Power Play staff or facilitators.

• Respect other participants' boundaries, privacy, identities, and disclosures.

• Refrain from harassment, bullying, threats, intimidation, discrimination, stalking, or abusive conduct.

• Refrain from unwanted sexual contact or sexual behavior toward another participant, facilitator, instructor, or staff member.

• Respect the confidentiality of personal information shared by other participants.

• Follow applicable laws and venue rules.
  
  

Power Play may remove or restrict the participation of anyone whose conduct creates a safety concern, materially disrupts an offering, violates these Terms, or compromises the wellbeing or privacy of others.

Where participation is terminated because of a participant's misconduct, fees will generally not be refunded unless otherwise required by law.

5. Consent & Personal Boundaries

Power Play's educational philosophy is grounded in consent, autonomy, and personal agency.

Participation in a Power Play activity never creates an obligation to disclose personal sexual information, participate in a physical activity, answer a personal question, engage in physical contact, or discuss an experience that makes you uncomfortable.

Participants may decline an activity or question at any time.

Where an in-person activity involves physical movement or contact, participants will receive appropriate instructions and may choose not to participate.

6. Digital Content & Intellectual Property

Power Play's courses, workshops, videos, written materials, presentations, worksheets, exercises, frameworks, branding, website content, and other educational materials are owned by or licensed to Power Play and are protected by applicable intellectual property laws.

Unless Power Play expressly states otherwise, your purchase or participation gives you a **limited, personal, non-exclusive, non-transferable license to access and use the applicable materials for your own personal educational purposes.**

You may not, without written permission:

• Copy, reproduce, or redistribute Power Play course or workshop materials.

• Share paid course access or login credentials.

• Upload Power Play materials to another website, platform, file-sharing service, or AI system.

• Record, livestream, or distribute Power Play workshops or classes.

• Sell, sublicense, or commercially exploit Power Play materials.

• Create a substantially similar commercial program using Power Play's proprietary curriculum or materials.

• Remove copyright, ownership, or other proprietary notices.

• Represent Power Play's materials or methodology as your own.

You may use materials provided for personal use in accordance with the instructions accompanying the applicable offering.

7. Digital Course Access

For self-paced digital programs, access is provided according to the terms described on the applicable sales or registration page.

Purchasing a digital program does not transfer ownership of the underlying videos, curriculum, recordings, written materials, or intellectual property to you.

If your access is terminated or a payment is reversed or refunded, your license to access and use the applicable paid materials ends unless Power Play expressly provides otherwise.

8. Participant Contributions

Power Play welcomes questions, reflections, feedback, and ideas from participants.

You retain ownership of your original personal content and experiences. By submitting material to Power Play for purposes such as feedback, testimonials, discussion, or educational participation, you grant Power Play permission to use that material only to the extent separately communicated to you and, where appropriate, with your consent.

Power Play does not acquire ownership of your personal stories, experiences, or intellectual property simply because you share them during a workshop or program.

9. Confidentiality & Community Privacy

Power Play will make reasonable efforts to protect participant information as described in its Privacy Policy.

Participants are also expected to respect the privacy of others.

You may not share another participant's personal information, disclosures, photographs, recordings, questions, or identifying details outside of a Power Play program without that person's permission.

Power Play cannot guarantee that another participant will maintain confidentiality. For this reason, participants should exercise discretion when deciding what personal information to disclose in group settings.

10. Photography, Audio & Video

Power Play may photograph, record, or livestream certain events for educational, promotional, or archival purposes **only where appropriate notice and consent have been provided**.

Participation in an event does not automatically grant Power Play unrestricted permission to use your likeness, voice, or personal disclosures for promotional purposes.

Where Power Play intends to use identifiable participant photography, video, audio, testimonials, or other personal content for promotional purposes, you may be asked to provide a separate release or consent.

Participants may not photograph, record, livestream, or otherwise capture another participant without that person's permission and without complying with Power Play's event rules.

11. Privacy

Power Play collects and uses personal information in accordance with its Privacy Policy.

Information may be collected to:

* Process registrations and payments.

* Provide access to Power Play programs and services.

* Communicate with participants.

* Administer events and educational offerings.

14. Health, Fitness & Movement Participation

Certain Power Play offerings may include Pilates-based movement, fitness education, or physical activity.

You understand that physical activity carries inherent risks, including the possibility of injury. You are responsible for informing Power Play of relevant limitations or concerns that may affect your participation and for obtaining appropriate medical clearance when necessary.

Power Play's movement programming is educational and is not a substitute for individualized medical evaluation, physical therapy, or treatment from a qualified healthcare professional.

Stop any activity that causes pain, dizziness, unusual discomfort, or other concerning symptoms and seek appropriate professional assistance when necessary.

15. No Guarantee of Results

Power Play provides education, tools, and practices intended to support greater body awareness, confidence, communication, sexual wellness, and physical wellbeing.

However, individual experiences and outcomes vary.

Power Play does not guarantee a particular physical, emotional, relational, or sexual outcome from participation in any program, workshop, course, class, or educational offering.

16. Suspension or Termination of Access

Power Play may suspend or terminate a participant's access to a program, event, community, website feature, or digital materials when reasonably necessary, including where a participant:

• Violates these Terms;

• Shares or misuses proprietary materials;

• Harasses or threatens another person;

• Engages in unsafe or disruptive conduct;

• Attempts to circumvent payment or access controls; or

• Creates a material safety, legal, or operational risk for Power Play or others.

Where access is terminated because of a participant's violation of these Terms, the participant may lose access to the applicable offering without a refund, except where otherwise required by law.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Power Play and its owners, employees, contractors, facilitators, instructors, and representatives will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from participation in or use of Power Play offerings.

To the extent permitted by law, Power Play's aggregate liability arising from a particular paid offering will not exceed the amount you paid to Power Play for that offering.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

18. Your Responsibility

You agree to take reasonable responsibility for your own participation, decisions, conduct, and use of Power Play materials.

You agree not to use Power Play offerings or materials in a manner that violates applicable law, infringes another person's rights, or creates an unreasonable risk of harm to yourself or others.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Power Play and its owners, employees, contractors, facilitators, instructors, and representatives from claims, losses, liabilities, and reasonable expenses arising from your intentional misconduct, violation of these Terms, or unlawful use of Power Play offerings or materials.

If any provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

These Terms do not create an employment, partnership, agency, fiduciary, or other relationship between you and Power Play beyond the services or educational relationship expressly described by the applicable offering.

These Terms, together with any applicable course-specific policies and Power Play's Privacy Policy, constitute the applicable terms governing your participation in Power Play offerings.

By purchasing, registering for, accessing, or participating in a Power Play offering, you acknowledge that you have had an opportunity to review these Terms and agree to be bound by them
